Veilpay Terms of Service
Legal note: This is a working draft, not legal advice, and has not been reviewed by counsel. Crypto payment products (especially those supporting privacy-native assets) can trigger money-transmitter licensing, MSB registration, AML/KYC, and sanctions-screening obligations that vary by jurisdiction. Have this reviewed by a qualified attorney, and confirm licensing requirements in every jurisdiction where Veilpay will operate, before publishing.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Veilpay application, website, and related services (collectively, the "Service"), provided by Veilpay ("Veilpay", "we", "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
Veilpay is a non-custodial, multi-chain crypto payments application. The Service enables you to:
- Create and manage a non-custodial wallet across supported networks (including EVM-compatible chains and Solana, as well as privacy-native networks such as Monero, Zcash, Midnight, and Stellar private payment flows);
- Send and receive digital assets using a selectable privacy tier (native privacy, zero-knowledge-wrapped privacy, or stealth-only privacy) depending on asset and network support;
- Access fiat-to-crypto and crypto-to-fiat conversion through our third-party partners including Stellar anchors, Transak, Onramp.money, and MoonPay, subject to their own terms and identity verification requirements.
Because Veilpay is non-custodial, we do not hold, control, or have access to your private keys or digital assets at any time. All transactions are signed and broadcast from your device under your control.
Supported assets, chains, and privacy tiers may change over time as described in Section 12 (Changes to the Service).
3. Eligibility and User Accounts
To use the Service, you must:
- Be at least 18 years old, or the age of legal majority in your jurisdiction;
- Not be located in, or a resident of, any country or region subject to comprehensive sanctions under applicable law, and not be listed on any applicable government restricted-party or sanctions list (e.g., OFAC's SDN List);
- Provide accurate information where an account or profile is required;
- Comply with all applicable laws in connection with your use of the Service.
You are responsible for maintaining the confidentiality of any account credentials, device access, and (critically) your wallet's seed phrase and private keys. Veilpay cannot recover lost seed phrases, reset wallet access, or reverse transactions.
4. Acceptable Use
You agree not to use the Service to:
- Engage in money laundering, terrorist financing, sanctions evasion, or other financial crime;
- Violate any applicable law, including securities, tax, export control, or anti-money-laundering law;
- Facilitate the purchase or sale of illegal goods or services;
- Defraud, deceive, or exploit any person;
- Interfere with, disrupt, or attempt unauthorized access to the Service or its underlying infrastructure;
- Use the Service if you are legally prohibited from doing so in your jurisdiction.
We may suspend or terminate access, and where legally required report activity to relevant authorities, if we reasonably suspect a violation of this section.
5. Fees
Use of the Service may involve:
- Network fees (e.g., gas or miner fees), set by the underlying blockchain and not by Veilpay;
- Veilpay service fees, if any, disclosed in-app prior to transaction confirmation;
- Transak fees, charged directly by Transak for fiat on-ramp/off-ramp services, disclosed by Transak prior to conversion.
All fees are disclosed prior to transaction confirmation. Blockchain transactions are generally irreversible once broadcast; review all transaction details carefully before confirming.
6. No Custody, No Investment Advice, No Guarantee of Anonymity
- Non-custodial: Veilpay never takes custody of your digital assets. You are solely responsible for the security of your device, seed phrase, and private keys.
- Not investment advice: Nothing in the Service constitutes financial, investment, tax, or legal advice. Digital assets are volatile and may lose some or all value.
- Not a bank: Veilpay is not a bank, and digital assets held in your wallet are not insured by any government deposit insurance program (e.g., FDIC, DICGC).
- Privacy, not absolute anonymity: Veilpay's privacy tiers are designed to enhance transaction privacy using stealth addressing, zero-knowledge techniques, and native privacy protocols. We do not guarantee complete or untraceable anonymity. The effectiveness of any privacy mechanism depends on the underlying protocol, network conditions, and how you use the Service, and may be affected by factors outside our control, including future changes in blockchain analysis techniques.
7. Third-Party Services
The Service integrates third-party providers, including Transak (fiat on/off-ramp) and blockchain node/infrastructure providers. Your use of these integrations is subject to the applicable third party's own terms and privacy policy. Veilpay is not responsible for the acts, omissions, availability, or performance of third-party services.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT ANY PRIVACY MECHANISM WILL RENDER A TRANSACTION UNTRACEABLE OR ANONYMOUS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Veilpay AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF FUNDS, PROFITS, OR DATA, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOSS OF PRIVATE KEYS OR SEED PHRASES, TRANSACTIONS SENT TO AN INCORRECT ADDRESS, NETWORK CONGESTION OR FAILURE, THIRD-PARTY SERVICE FAILURES, OR UNAUTHORIZED ACCESS TO YOUR DEVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF USD 100 OR FEES PAID TO VEILPAY IN THE PRECEDING 12 MONTHS.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Veilpay from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Service.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including where we reasonably believe you have violated these Terms, applicable law, or sanctions requirements. You may stop using the Service at any time. Because Veilpay is non-custodial, termination of your access to the app does not affect your ownership or control of assets held in your wallet, which remain accessible via your seed phrase independent of Veilpay.
12. Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service, including supported chains, assets, or privacy tiers, at any time. We may also update these Terms from time to time; material changes will be communicated via in-app notice and email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the applicable jurisdiction, without regard to conflict-of-law principles.
